2nd DUI conviction and moving out of state

2nd DUI conviction and moving out of state

Question: I got my 2nd DUI in Santa Clarita, CA and just started my DUI program and will be moving out of state. My first DUI was in San Fernando, CA 6 years ago. I have one month until i am able to get my IID installed in my vehicle, will I be able to transfer the DUI program and etc to NC and what does this involve?
Answer: The court may allow you to do an equivalent out of state program for purposes of your probation (you would need to get court approval) , but that would not satisfy the DMV for purposes of getting your CA license (restricted or otherwise).  What that means is that CA will keep a hold on your drivers license until either you complete the required CA alcohol program or fill out what is called a DMV 1650 waiver form.
Additionally, you will not be able to get credit for the classes you did in CA if you transfer to NC or another state prior to completing the program here.
Before you make any moves, you should contact your attorney who handled your case.
