DUI Expungement in Van Nuys Court

Question: If I get my DUI expunged, what happens if I get another DUI? Would it only be a 1st DUI at that point if the expungement was successful?

  1. Answer: No, a DUI expungement has benefits to it, particularly when applying for jobs, but it does not remove the “prior-ability” of the DUI even after it is expunged. So if you get a DUI within 10 years of a previous DUI (even if expunged), it will likely be charged as a 2nd offense DUI with few exceptions.
    I still recommend getting the expungement for DUI. Best to get it as soon as possible so you are not crunching for time when you actually need the expungement to go through.
